Supreme Court Declines to Hear Case Involving Visa, Mastercard and ATM Fees, Meaning Case Will Continue

]WASHINGTON–The Supreme Court said it will not review a case brought by three ATM manufacturers that have accused Visa and Mastercard of unfairly setting fees for ATM transactions. 

The decision means the case will continue in a lower court.

The plaintiffs had asked the Supreme Court to review a decision made by a lower court that allowed the case to proceed as a class-action lawsuit. In its ruling, the lower court agreed to certify two classes of plaintiffs as part of the lawsuit: ATM owners and consumers who claim they were overcharged.

Certification to Stand

The decision not to intervene means that the certification of these groups will stand.

The plaintiffs are alleging that the two giant card networks have  conspired to keep ATM fees high and limit competition between ATM networks.

Visa and Mastercard had argued that the lower court’s decision to certify the groups was incorrect due to there not being enough common evidence to prove that everyone in the groups was harmed in the same way.
