Portal Now Available to File Claims Related to WaWa Data Breach; Deadline in August

PHILADELPHIA–Credit unions that wish to file a claim in the $28.5 million settlement over a data breach at WaWa convenience stores now have a deadline for doing so, as well as a website at which to file claims.

As CUToday.info reported earlier, in March a settlement was announced in the case involving the 2019 breach. In the case, hackers accessed Wawa’s point-of-sale systems, installed malware, and tried to sell stolen customer payment card data on the dark web.   The breach, which lasted more than nine months, exposed cardholders’ names, numbers, and expiration dates used in-store and at gas pumps at all Wawa stores.

Three credit unions, Inspire FCU, Insight Credit Union and Greater Cincinnati Credit Union, had filed the proposed class action against the company.

At that time, terms of the proposed settlement included $18.5 million in compensation to financial institutions for card cancellation and replacement costs related to the breach, $8 million to credit unions to cover fraudulent charges on members’ cards, and $2 million to be divided on a pro rata basis to class members who elect to accept a fixed payment as part of the settlement.

Three Types of Claims

According to the law firm Lowey Dannenberg, three types of claims may be made:

  • Tier 1 - Cancellation and Replacement Claims, providing a cash payment for any Impacted Card cancelled and replaced
  • Tier 2 - Fraud Related Claims, providing a cash payment for unreimbursed expenses caused by fraudulent charges on Impacted Cards
  • Tier 3 - Other Costs – Alternative Claims – providing a cash payment without the need for supporting documentation as an alternative to Tiers 1 and 2 claims.

Lowey Dannenberg said notices have been sent to credit unions and there is a claims deadline of Aug. 12.
