ALEXANDRIA, Va.—Will Todd Harper and Tanya Otsuka attend Thursday’s NCUA board meeting?
That’s a question not being answered by NCUA or the two Democratic board members.
As CUToday.info reported, the Trump Administration has filed a motion to stay a federal judge’s ruling that NCUA Board Members Harper and Otsuka were unlawfully removed from their positions, and must be immediately reinstated.
CUToday.info reached out to Harper and Otsuka’s legal firm, Holwell Shuster & Goldberg LLP, and NCUA for answers, but none were provided.
However, a minute order issued by the District Court mid-day Wednesday suggests the court won’t be making a decision on the motion to stay by 10 a.m. Thursday, when the board meeting is set to begin, allowing Harper and Otsuka to attend if they choose to do so—as they are not formally prohibited from participating.
“The Court is in receipt of Defendants' motion to stay the Court's order pending appeal. The motion does not address the Board meeting scheduled to take place on July 24, 2025, or suggest that it provides any basis for a stay. Plaintiffs shall respond to the motion by July 24, 2025, at noon,” the order states.
“Because the government did not ask for a decision to be made before the board meeting, the District Court is not taking steps to do so,” Brandy Bruyere, partner at Honigman, LLP, told CUToday.info.
In the Trump Administration’s legal battle with Federal Trade Commissioner Rebecca Kelly Slaughter, the court moved quickly to temporarily pause a lower court order that had reinstated Slaughter.
NCUA informed CUToday.info Wednesday afternoon that Thursday’s meeting will proceed as scheduled. A source told CUToday.info that Harper might join the meeting remotely via Zoom.
