Court Rules Bank’s Dozen Calls to Customer Are Sufficient Basis for Lawsuit

CINCINNATI–A bank here is facing a proposed class action suit over robocalls that used artificial or prerecorded messages to cell phones. The suit alleges the bank violated the Telephone Consumer Protection Act.

According to plaintiff Tatum Stamler, she received 13 calls from the bank, a “sufficient allegation of injury to establish standing to sue under TCPA,” Magistrate Judge Stephanie K. Bowman of the U.S. District Court for the Southern District of Ohio said in a June 28 opinion, Bloomberg Law reported.

Bowman is recommending that Guardian’s motion to dismiss be denied.
