Cornerstone League, CUNA File New Amicus Brief In Website/ADA Lawsuit

PLANO, Texas–The Cornerstone Credit Union League and CUNA have filed an amicus brief supporting a motion to dismiss a lawsuit filed against Local 20 IBEW Federal Credit Union that alleges the CU’s website violates the Americans with Disabilities Act.

The suit, one of a wave of similar suits filed across the U.S. against credit unions, was filed in the Northern District of Texas.

Similar to the briefs filed in other cases, the latest brief argues that the plaintiff, a California resident, does not have standing to bring suit because she is not eligible for the credit union’s field of membership. The brief also argues that a website is not a place of public accommodation, among other legal arguments.

"Credit unions across the country have been hit with virtually identical frivolous lawsuits from plaintiffs' firms exploiting a law designed to protect those with legitimate disabilities," said Cornerstone President/CEO Caroline Willard in a statement. "Cornerstone vigorously opposes such predation and supports credit unions in their defense against the allegations. Again, we urge Congress to confirm that the ADA does not apply to websites."

The Cornerstone league and CUNA are being represented by Brownstein Hyatt Farber Schreck, LLP in the filing.
