CUNA To File Amicus Brief In Support Of CU Defendant In ADA Case

WASHINGTON—As Americans with Disabilities Act website accessibility cases against credit unions continue to work their way through the federal court system—some now reaching the appellate court level—CUNA said it is preparing to submit another amicus brief in support of a CU defendant.

This time the brief supports a credit union under the jurisdiction of the U.S. Court of Appeals for the Seventh Circuit.

“We will be filing the brief Thursday,” said Alexander Monterrubio, CUNA senior director of advocacy and counsel. “We will be supporting the credit union involved in the case, specifically arguing that the plaintiff lacks standing to pursue an action against the credit union regarding ADA website claims.”

Monterrubio did not name the credit union.

“We will be filing the brief jointly with the state leagues from Indiana, Wisconsin and Illinois,” continued Monterrubio. “These are states that would be impacted by any decision from the Seventh Circuit Court of Appeals. This is the second case to reach the appellate court level involving a plaintiff’s standing with a credit union.”
