CUNA, NAFCU Join With Other Groups in Calling for Fix to FTC Order

WASHINGTON—NAFCU and CUNA have joined with several financial trade organizations to send a letter to the Federal Communications Commission (FCC) calling for an urgent fix to the commission's order codifying exemptions to the Telephone Consumer Protection Act (TCPA).

The group met with staff from FCC Acting Chair Jessica Rosenworcel's office in February to discuss this issue.

The group has previously noted an error present in the order's text that creates a requirement that informational, prerecorded or artificial voice calls placed by a caller to a residential number outside of the three-call exemption would be subject to a prior express written consent requirement. However, elsewhere, the order indicates that calls placed outside of the exemption should be subject to prior express consent, and not written consent, NAFCU noted.

In the letter, the group requested that the FCC immediately issue an erratum removing the word "written" from the consent standard.
