CHICAGO–The U.S. Court of Appeals for the 7th Circuit dismissed a lawsuit against Illinois-based Aurora Policemen Credit Union that alleged its website violated the violations of the Americans with Disabilities Act (ADA). The case is similar to numerous other lawsuits brought against credit unions over the same issue, a number of which have also been dismissed.
CUNA, along with the Illinois and Wisconsin CU Leagues, had earlier filed an amicus brief in the case.
The 7th Circuit agreed with the district court that the plaintiff has not suffered an injury-in-fact, which is required to establish standing. This is the second win for credit unions at the appellate level, the first coming in the Fourth Circuit in cases involving Northwest FCU and Department of Labor of FCU, as CUToday.info reported here.
