Another CU Files Suit Against Home Depot

SALAMANCA, N.Y.— Cattaraugus County School Employees FCU has filed suit against Home Depot seeing damages following the massive data breach at the company earlier this year. The suit was filed in federal court in Atlanta by the credit union, according to the Atlanta Business Chronicle.

CCSEFCU becomes the second credit union in the Buffalo area to pursue litigation against Home Depot, joining Buffalo-based Southern Chautauqua FCU. In its suit, Cattaraugus County School Employees is alleging that the data breach "easily could have been prevented as Home Depot failed to take adequate and reasonable measures to ensure its data systems were protected, ignored numerous clear warnings that its data systems were outdated and thus vulnerable to attack, and failed to take actions that could have thwarted the breach." The CU said it has incurred and will continue to incur costs related to investigating fraudulent transactions and replacing cards. Some 21 federal lawsuits have now been filed against Home Depot over the suit, with many asking for class action status. The credit union is being represented by Atlanta attorney W. Pitts Carr.
