Alaska Supreme Court to Hear Arguments in Case Involving Credit Union

ANCHORAGE, Alaska—The Alaska Supreme Court set oral arguments for Sept. 12 in a lawsuit involving Global Credit Union’s (formerly Alaska USA Federal Credit Union) claim to surplus funds from a nonjudicial foreclosure sale of real property.

CUNA and the Alaska Credit Union League filed an amicus brief in support of Global CU with the Alaska Supreme Court in April.

Then-Alaska USA recorded a lien judgement against a member in January 2014, and the state of Alaska Child Support Services Division (CSSD) recorded a lien against that same member in September 2017. Superior and district courts in subsequent years granted CSSD’s motion for summary judgement that it had lien priority over the earlier recorded judgement of Alaska USA, CUNA said.

CUNA and the Alaska League are arguing the district court made an error in determining priority and are urging the Alaska Supreme Court to reverse the district court’s decision.
