2 People File Class Action Lawsuit Against Navy Federal Related To Overdrafts

SAN DIEGO—Two people in California have filed a class action lawsuit against Navy Federal Credit Union, alleging breach of contract related to its overdraft program.

Jenna Lloyd and Jamie Plemons filed a complaint, individually and on behalf of all others similarly situated, on June 22 in U.S. District Court for the Southern District of California against Navy Federal alleging that it charged optional overdraft protection services (OOPFs) on the plaintiffs' APPSN transactions.

Lloyd and Plemons allege in the complaint that they sustained monetary damages as the result of being charged with the optional overdraft protection services, and further allege Navy Federal Credit Union allowed the APPSN transactions to incur OOPFs.

The plaintiffs are seeking trial by jury and seeking restitution, disgorgement, actual damages, punitive and exemplary damages, interest, attorney fees and other relief the court deems just and proper.

They are represented by attorney Jeffrey Kaliel of Tycko & Zavareei LLP in Washington.

Navy Federal, the world’s largest credit union at $81.5 billion in assets, is based in Vienna, Va.
